VICTORY! 11/29/2022 City Council by Unanimous Vote

We did it, all of us!  After 6 months of fighting for our park and neighborhood, on the evening of 11-29-2022, the city council of San Jose voted unanimously to remove our beloved Penitencia Creek Reach 2 Park from the EIH list and permanently protect it from future development.  Thank you everyone for all your time, work and energy in making this happen.  We are a blessed community. We are so grateful to have met so many wonderful neighbors that we now call friends.  Blessings!  Merry Christmas & Happy New Year    Robert and Sandra    Look what we saved!:

and on the same evening, at the same meeting

neighbors from district 10 filled chamber seats with their signs; to begin their protest

like us, back in june

they too had a stealth bomb of a vote dropped on them.  Cottle/VTA near Kaiser.
another highly inappropriate site for densely populated caged tiny home sites

based on our experience, we know they have a significant battle ahead

i feel the swell of an ALL DISTRICTS UPRISING...

because that's what it will take.

BE SEEN * BE HEARD 7pm Tonight Council Members Re-VOTE 11/29/22

NOTonNOBLE Community:  We are on the city council agenda Nov 29th, 2022, Item 8.3

We anticipate a hard earned partial victory:   The Noble Location, Penitencia Creek Reach 2, officially removed as a potential site for tiny homes;

WE DO NOT CLAIM FULL VICTORY UNTIL:  -Penitencia Creek Reach 2 RECEIVES PERMANENT PROTECTION from any development in the future.

6PM:  PLEASE JOIN US AT THE CHAMBERS IF YOU CAN.   Even if you do not plan to speak, your presence is highly valued. Bring family & friends.  For those who plan to speak, WE can do so at the time Item 8.3  is up for discussion; we are not forced to wait until open forum.

It is a hybrid meeting, so you can join via zoom also.

Robert and Sandra highly recommend this documentary:  SEATTLE IS DYING  It speaks -as if a prelude, to the crisis we are seeing/experiencing here in San Jose.   We should learn from other cities/states; discuss and apply the lessons.

Current Services Available in San Jose

There doesn't seem to be a shortage of services.  Homelessness is not a new issue; it was identified as a crisis prior to the 2020 pandemic,  which is Why Measure A, $950million bond was passed.

all these services; all this money, and we only read about the homeless population growing.

We would love to learn which services are succeeding/helping, and which need revamped.

WE WILL ACTUALLY BE ON THE CITY COUNCIL AGENDA 11/29/22
which means we do not have to wait for open forum to speak, and to my understanding
we will not be restricted to 60 seconds.

*******

BE SEEN, BE HEARD

NOTonNOBLE   -We are not done.  We do not claim victory until:

*  NOBLE AVE/Penitencia Creek Reach 2 is PERMANENTLY PROTECTED from any type of development; ever.

*  And we must make clear:  PROTECTION from development is not contingent upon finding an alternative site.  Our sacred park is off limits; period.  In fact, it should have never been put on the table for consideration a second time.

Join us, Tues Nov 15th, 3pm.   Wear your NOT on NOBLE T-shirts, Create a t-shirt if you do not already have one.  Make posters (and we will have extra signs available).  YOUR PRESENCE IS VALUABLE AND APPRECIATED whether you plan to speak or not.  Bring your friends and family.  For those who intend on speaking: Prepare your 1 to 2 minute speech for open forum.  This is our last opportunity to be seen and/or be heard prior to council's vote on Tues Nov 29th, when our protest will be officially on the agenda.

*****

"THANK YOU!" TO OUR LEGAL TEAM

We will not wait for the City of San Jose to inventory and assess every park in this 10th largest city in the nation, before they can officially call our park, A PARK.  The numerous historical documents which already declare Penitencia Creek Reach 2 as Open Space protected, and numerous signs/documents which identify Penitencia Creek Reach 2, as a park; plus the actual use of this land as a park by several generations..

All of this makes their postponement ludicrous and unacceptable.

A letter from Silicon Valley Law Group (SVLG) was sent to Mayor Sam Liccardo, via hand delivery and electric mail, on Nov 9th, 2022.

Check back here  -We will update when we are in receipt of a response.

See you tuesday,   Blessings, Robert & Sandra
